These Terms of Service ("Terms") govern your purchase and use of the My Virtual CPA software and website (the "Service"), provided by Eugenius Enterprises LLC ("we", "us"). By downloading, purchasing, or using the Service, you agree to these Terms.
Subject to these Terms and payment of the applicable fee, we grant you a personal, non-exclusive, non-transferable license to install and use My Virtual CPA on devices you own or control, for your own personal and/or business use, according to the edition you purchased. A purchased license is perpetual for the edition's features as delivered; optional add-ons (e.g., Cloud & Updates) are provided on a subscription basis.
We offer a 30-day free trial. A valid payment method is required to start it, but you are not charged during the trial. If you do not cancel before the trial ends, your subscription begins and your payment method is charged the then-current fee. Subscriptions are billed monthly or annually and renew automatically until cancelled. You may cancel anytime; access continues through the end of the current billing period.
Payments are processed by Lemon Squeezy, our authorized payment provider and Merchant of Record. Lemon Squeezy handles billing, sales tax/VAT, and payment terms, and collects and remits applicable taxes on these transactions.
Because of the 30-day free trial, subscription fees are generally non-refundable; you may cancel anytime to stop future charges. See our Refund Policy for details.
My Virtual CPA provides financial estimates and organizational tools only. It is not tax, legal, or accounting advice and is not a substitute for a licensed professional. Calculations are based on the data you enter and may not reflect all applicable laws. You are responsible for verifying figures and should consult a licensed CPA, Enrolled Agent, or attorney before filing taxes or making financial decisions.
The Service stores your data locally on your device. You are responsible for maintaining backups. We are not liable for data loss; the app provides backup and restore tools to help you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EUGENIUS ENTERPRISES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE.
We may suspend or terminate your license if you materially breach these Terms (including revoking a license associated with a fraudulent chargeback). Upon termination, you must stop using and remove the Service.
These Terms are governed by the laws of the State of Florida, USA (the state in which Eugenius Enterprises LLC is organized), without regard to conflict-of-law rules.
